BSQ News - Roger Sahota instructed in Landmark European Court Extradition Challenge

A BSQ extradition case has been deemed admissible by the European Court of Human Rights and will shortly be listed for a full hearing.

BSQ partner Roger Sahota represents the Appellant in the case of S. An extradition request has been made by the United States of America requesting S’s removal to the USA. BSQ are appealing the Secretary of State’s decision to order S’s extradition.

The grounds relied upon include a challenge to the provisions in the United States for life sentence prisoners. S is accused of drug trafficking offences in the USA. There is a real risk that S may receive a life sentence if he is removed to America. S argues that the life sentence arrangements in the US infringe Article 3 of the European Convention which states that

“no one shall be subjected to torture or to inhuman or degrading treatment or punishment',

Article 3 outlaws life sentences that are “irreducible.” The European Court has imposed a state preventing his removal to the United States until the case is heard in Strasbourg.

The case of S will shortly be listed for a full hearing before the ECHR. Mr Sanchez is also represented by Ben Keith and David Josse QC of 5 St Andrews Hill.
