Berkeley Square Solicitors Instructed in Landmark Emergency CAT Injunction Application

Berkeley Square Solicitors have lodged an emergency injunction application in the Competition Appeal Tribunal on behalf of our clients UKRS Ltd. Changes to the procedural rules of the CAT bought about by the Consumer Rights Bill of 2015 allow claimants to apply for an injunction before any claim for relief in competition law is lodged. This is only the second time an injunction application has been lodged before the CAT (see NCRQ v Institute of Occupational Safety and Health).  UKRS have applied for an injunction restraining the NSAR from continuing to abuse its dominant position in a standalone claim for damages pursuant to s47A of the Competition Act 1998, as amended by the Consumer Rights Act 2015.

At present the case is fixed to be the first contested injunction application listed before the CAT.
